These Terms of Service (“Terms”) govern your access to and use of the Wichita Falls Concrete Pro website, including its content, project inquiry forms, and related features (collectively, the “Website”).
In these Terms:
- “Website Operator” means the person or entity that owns, manages, or operates the Website and its inquiry and referral systems.
- “Service Provider” means an independent concrete contractor or other third-party provider that may respond to an inquiry, provide an estimate, enter into a service agreement, or perform concrete-related work.
- “You” means the person accessing the Website or submitting a project inquiry.
The Website is presented as a local concrete service website through which property owners may obtain information, ask questions, and request estimates. References to “we,” “us,” and “our” in general Website content may describe the overall customer-facing service process. However, responsibility for a specific estimate, contract, payment, project, warranty, or construction service belongs to the party identified in the applicable communication or written agreement.
By accessing the Website or submitting a project inquiry, you agree to these Terms. If you do not agree, do not use the Website or submit information through it.
1. Website Use
You may use the Website for lawful purposes related to learning about or requesting concrete repair, replacement, or related services.
You may not use the Website in a manner that violates applicable law, interferes with Website operation, compromises security, infringes another person’s rights, or submits false, fraudulent, abusive, or misleading information.
The Website is intended primarily for adults and property owners, occupants, managers, or authorized representatives seeking concrete services.
2. Service Information
The Website provides general information about concrete repair, concrete replacement, project evaluation, common concrete conditions, service processes, cost factors, scheduling considerations, and related topics.
Information presented on the Website is not a final diagnosis, engineering opinion, construction specification, binding estimate, warranty, or promise that a particular repair or replacement method is appropriate for a specific property.
The appropriate project scope may depend on conditions that cannot be determined solely from photographs or written descriptions, including:
- Slab movement;
- Subgrade and base conditions;
- Drainage;
- Reinforcement;
- Measurements;
- Access limitations;
- Utilities;
- Adjoining structures;
- Weather;
- Permit requirements; and
- Conditions discovered during demolition or construction.
Additional information, measurements, photographs, or an on-site evaluation may be required before a project scope can be confirmed.
3. Project Inquiry and Referral Relationship
The Website may operate as a project inquiry, advertising, lead-generation, and referral service.
When you submit an inquiry, the Website Operator may collect, review, organize, store, transmit, or share the information with one or more independent Service Providers that may be able to respond.
The Website Operator may receive compensation for:
- Advertising;
- Referrals;
- Lead-generation services;
- Access to project inquiries;
- Website rental;
- Marketing services; or
- Related commercial arrangements.
Such compensation does not increase the price of a project unless the responding Service Provider separately states otherwise.
Submitting an inquiry authorizes the processing and sharing of your information as described in these Terms and the Privacy Policy.
4. Independent Service Providers
A Service Provider receiving an inquiry is an independent business.
Unless expressly stated in a separate written agreement, a Service Provider is not an employee, agent, partner, joint venturer, representative, or subcontractor of the Website Operator.
A responding Service Provider may:
- Contact you regarding the inquiry;
- Ask follow-up questions;
- Review photographs or project information;
- Arrange an on-site evaluation;
- Recommend repair, partial replacement, or full replacement;
- Provide an estimate or proposal;
- Schedule work;
- Enter into a contract with you;
- Perform or subcontract the work;
- Collect payment; and
- Provide any applicable workmanship warranty.
The Service Provider controls its own methods, personnel, pricing, scheduling, equipment, safety practices, contractual terms, and business operations.
5. Website Operator and Contractor Roles
The Website Operator manages the Website and may receive, process, route, or refer project inquiries.
The Website Operator is not necessarily the contractor that will inspect the property, issue the estimate, enter into the construction contract, receive payment, supervise the work, perform the work, or provide the warranty.
A Service Provider may communicate through the Website’s inquiry process or use the Website’s business name when responding to an inquiry. This does not, by itself, make the Website Operator the contractor responsible for the project.
Before authorizing work or making payment, you should obtain documentation identifying the individual or business responsible for:
- The estimate;
- The construction contract;
- Payment collection;
- Project performance;
- Permits;
- Insurance;
- Workmanship; and
- Warranty obligations.
Where the Website Operator is expressly identified as a contracting party in a separate written agreement, the terms of that agreement will govern the Website Operator’s responsibilities for that transaction.
6. No Guarantee of Response or Service
Submitting a project inquiry does not:
- Create a construction contract;
- Guarantee that a Service Provider will respond;
- Guarantee an on-site evaluation;
- Guarantee that an estimate will be provided;
- Guarantee that the project will be accepted;
- Reserve a project date;
- Establish a final scope or price;
- Guarantee that repair will be suitable;
- Guarantee that replacement will be available; or
- Guarantee that work can be legally, safely, or practically performed.
An inquiry or project may be declined due to location, scope, availability, site conditions, safety concerns, insurance restrictions, permit requirements, scheduling, or other business considerations.
An automated confirmation or acknowledgment only confirms that the inquiry was submitted or received. It does not confirm project acceptance.
7. Estimates, Pricing, and Availability
Cost information shown on the Website is general information unless expressly presented as a written estimate from a specific Service Provider.
Actual pricing may depend on factors including:
- Project dimensions;
- Demolition and disposal;
- Concrete specifications;
- Reinforcement;
- Base preparation;
- Grading and drainage;
- Site access;
- Equipment and labor requirements;
- Surface finish;
- Permit or inspection requirements;
- Weather conditions; and
- Conditions discovered after work begins.
Only the Service Provider issuing an estimate is responsible for explaining:
- Whether the estimate is binding or nonbinding;
- What work is included or excluded;
- How long the estimate remains valid;
- Required deposits or payments;
- How additional work is approved; and
- How changes in price or scope will be handled.
The Website Operator does not guarantee a Service Provider’s pricing, availability, estimate, response time, or continued willingness to accept a project.
8. Agreements Between Customers and Service Providers
Unless the Website Operator is expressly identified as a contracting party in writing, any agreement for evaluation, construction, repair, replacement, payment, or warranty services is solely between you and the applicable Service Provider.
You are responsible for reviewing the Service Provider’s proposal or contract before authorizing work.
A written project agreement should identify, as applicable:
- The Service Provider’s legal or business name;
- Contact information;
- The work included and excluded;
- Materials and specifications;
- Price and payment schedule;
- Deposits;
- Change-order procedures;
- Estimated start and completion dates;
- Delay and weather provisions;
- Site-access responsibilities;
- Permit and inspection responsibilities;
- Cleanup and disposal;
- Damage-reporting procedures;
- Warranty terms and exclusions; and
- Cancellation or dispute procedures.
The Website Operator does not become a party to a customer–provider agreement merely because the inquiry originated through the Website.
9. Contractor Selection, Licensing, Insurance, and Qualifications
You are responsible for deciding whether to hire a particular Service Provider.
Before authorizing work, you should independently verify any matters important to the project, including:
- The provider’s identity and contact information;
- Relevant experience;
- References or complaint history;
- Licenses or registrations required for the work;
- Insurance coverage;
- Bonding, where applicable;
- Permit responsibilities;
- Written pricing and project scope;
- Warranty terms; and
- The use of subcontractors.
Licensing, registration, permit, and insurance requirements may differ depending on the jurisdiction, project type, property, and scope of work.
Receiving an introduction or response through the Website is not a representation that the Service Provider holds every license, registration, permit, insurance policy, certification, or qualification that may apply to the project.
Unless expressly confirmed in writing, the Website Operator does not certify or guarantee a Service Provider’s:
- Licensing;
- Insurance;
- Qualifications;
- Financial condition;
- Legal compliance;
- Reputation;
- Availability; or
- Suitability for a particular project.
10. Workmanship, Warranties, Scheduling, and Payments
The Service Provider identified in the applicable estimate or construction agreement is responsible for its work and contractual obligations.
Unless the Website Operator separately assumes responsibility in writing, the Website Operator does not control or guarantee:
- Workmanship;
- Construction quality;
- Materials;
- Concrete color or texture matching;
- Project specifications;
- Code or permit compliance;
- Site safety;
- Property protection;
- Start or completion dates;
- Weather delays;
- Curing periods;
- Subcontractor performance;
- Cleanup or disposal;
- Deposits;
- Invoices;
- Refunds;
- Collections;
- Change orders;
- Manufacturer warranties;
- Labor warranties; or
- Correction of defective or incomplete work.
Questions regarding a specific project, payment, warranty, delay, damage, or workmanship issue should first be directed to the Service Provider identified in the project agreement.
11. Your Project Information and Uploaded Content
You agree to provide information that is accurate to the best of your knowledge and reasonably relevant to the project.
You represent that you have authority to submit information concerning the property and to upload any photographs or other materials you provide.
Do not submit:
- Identification documents;
- Bank, payment-card, or financial account information;
- Medical information;
- Unnecessary confidential information;
- Content that infringes another person’s rights;
- Images of faces, people, license plates, or private areas when unnecessary;
- Malware or harmful files; or
- False, threatening, fraudulent, or unlawful content.
You retain ownership of original photographs and materials you submit.
You grant the Website Operator a limited, nonexclusive right to store, process, reproduce, transmit, and share the submitted materials as reasonably necessary to review, document, secure, route, and respond to the inquiry in accordance with the Privacy Policy.
12. Accuracy and Availability of Website Content
We attempt to provide useful and reasonably accurate information. However, the Website may contain errors, omissions, outdated information, or generalizations that do not apply to a particular project.
The Website Operator does not guarantee that Website content is:
- Complete;
- Current;
- Error-free;
- Available at all times;
- Suitable for every property; or
- Sufficient to make a construction decision without further evaluation.
Website content may be updated, corrected, removed, or changed without notice.
The Website does not provide engineering, architectural, surveying, legal, insurance, tax, environmental, utility-location, building-code, or professional safety advice.
You should consult an appropriately qualified professional or government authority when a project involves structural conditions, drainage design, utilities, boundaries, accessibility, engineering, public property, permits, or other regulated matters.
13. Intellectual Property
Unless otherwise stated, the Website’s original text, design, layout, graphics, branding, logos, code, and other original content are owned by or licensed to the Website Operator and are protected by applicable intellectual-property laws.
You may view or print reasonable portions of the Website for personal, noncommercial project-planning purposes.
Without prior written permission, you may not:
- Republish Website content;
- Sell or license Website content;
- Systematically copy or scrape Website content;
- Create a competing commercial database from Website content;
- Use Website branding in a misleading manner; or
- Suggest that another business is sponsored or endorsed by the Website.
Third-party trademarks, images, names, and materials remain the property of their respective owners.
14. Third-Party Links and Services
The Website may link to government websites, mapping services, product information, Service Provider websites, or other third-party resources.
Third-party links are provided for convenience and do not necessarily constitute endorsement, certification, sponsorship, or approval.
The Website Operator does not control and is not responsible for third-party:
- Content;
- Availability;
- Security;
- Privacy practices;
- Representations;
- Products;
- Services; or
- Transactions.
Your use of a third-party website or service is governed by that third party’s terms and policies.
15. Prohibited Uses
You may not:
- Use the Website for unlawful, deceptive, or fraudulent purposes;
- Submit fabricated or impersonated project inquiries;
- Interfere with Website operation or security;
- Attempt to bypass access controls, anti-spam systems, bot protection, or rate limits;
- Upload malware or malicious code;
- Scrape or systematically extract Website data without permission;
- Use the Website to distribute spam;
- Infringe intellectual-property, privacy, or other legal rights;
- Misrepresent your relationship with the Website or a Service Provider; or
- Use Website content or branding to confuse users about the source of another service.
The Website Operator may reject submissions, restrict access, preserve records, or report conduct when reasonably necessary to protect the Website, users, Service Providers, or others.
16. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
THE WEBSITE OPERATOR DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES REGARDING THE WEBSITE, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
THE WEBSITE OPERATOR DOES NOT WARRANT THAT:
- THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
- A SERVICE PROVIDER WILL RESPOND;
- AN INQUIRY WILL RESULT IN AN ESTIMATE OR PROJECT;
- A PARTICULAR PRICE OR SCHEDULE WILL BE AVAILABLE;
- A SERVICE PROVIDER WILL PERFORM WORK TO A PARTICULAR STANDARD; OR
- A SERVICE PROVIDER WILL HONOR A PARTICULAR REPRESENTATION OR WARRANTY.
Nothing in these Terms excludes any warranty, duty, right, or remedy that cannot lawfully be excluded.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE OPERATOR AND ITS OWNERS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO:
- Use of or inability to use the Website;
- Reliance on Website content;
- Submission, transmission, storage, or loss of an inquiry;
- A Service Provider’s response or failure to respond;
- Selection or rejection of a Service Provider;
- An estimate, price, schedule, deposit, payment, or refund;
- Construction work or failure to perform work;
- Defective, incomplete, or allegedly defective work;
- Project delay, interruption, or cancellation;
- Property damage;
- Personal injury;
- Permit, licensing, insurance, code, or warranty issues;
- Acts or omissions of a Service Provider, subcontractor, supplier, property owner, or other third party; or
- A dispute between you and a Service Provider.
These limitations apply regardless of whether the claim is based on contract, tort, negligence, statute, strict liability, or another legal theory.
To the maximum extent permitted by law, the Website Operator’s total liability for a claim arising solely from use of the Website will not exceed the greater of:
- The amount you paid directly to the Website Operator for use of the Website during the twelve months preceding the event giving rise to the claim; or
- One hundred U.S. dollars.
These limitations do not apply to the extent liability results from the Website Operator’s own fraud, willful misconduct, or another matter for which liability cannot lawfully be limited.
Nothing in these Terms releases a Service Provider from responsibility for its own contracts, representations, work, negligence, warranties, or legal obligations.
18. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless the Website Operator and its owners, officers, employees, representatives, and affiliates from third-party claims, liabilities, losses, damages, and reasonable costs arising from:
- Information or content you submit;
- Your unlawful or prohibited use of the Website;
- Your infringement of another person’s rights;
- Your misrepresentation that you are authorized to submit property information or photographs; or
- Your material violation of these Terms.
This section does not require you to indemnify any person for that person’s own negligence, fraud, willful misconduct, or wrongdoing where such indemnification is prohibited by law.
19. Privacy
The collection, use, storage, and sharing of personal information are described in the Privacy Policy.
The Privacy Policy is incorporated into these Terms by reference. If there is a direct conflict regarding the handling of personal information, the Privacy Policy controls for that issue.
After inquiry information is shared with a Service Provider, that provider may independently use and retain the information under its own privacy practices. Requests concerning information independently retained by a Service Provider may need to be directed to that provider.
20. Governing Law and Venue
These Terms are governed by applicable law, except where another law must apply.
Any legal proceeding arising solely from use of the Website will be brought in a court of competent jurisdiction as required by applicable law.
A project contract issued by a Service Provider may contain its own governing-law, venue, arbitration, mediation, or dispute-resolution provisions. Those provisions apply to the customer–provider relationship as stated in that contract and do not automatically govern disputes involving only the Website Operator.
21. Severability and No Waiver
If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted or modified only as necessary to make it enforceable.
The remaining provisions will continue in effect.
Failure to enforce a provision does not waive the right to enforce it later.
22. Changes to These Terms
The Website Operator may update these Terms when Website features, referral practices, Service Provider relationships, business operations, or legal requirements change.
Revised Terms will be posted on this page with an updated “Last updated” date.
Changes apply prospectively from the posted effective date unless applicable law requires otherwise.
Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms.
23. Contact
For questions concerning these Terms, use the contact form and state that your message concerns the Terms of Service.
